Acceptance of Terms

By accessing and utilizing the application, users unequivocally acknowledge and consent to the terms and conditions set forth herein. These terms constitute a legally binding agreement between the user and the app, governing the use of our services. Should users disagree with any part of these terms, they are advised to refrain from accessing or using the app.

Definitions

To facilitate comprehension and precision throughout this agreement, certain terms are defined herein:

• App: refers to the mobile application operated by us.
• User: This term encompasses any individual utilizing the app, whether it be an Individual User or a Team Manager acting on behalf of a group of players.
• Team: A Team refers to a collective of players represented by a Team account, which is managed by a designated Team Manager.
• Event: Within the app, an Event is characterized by specific attributes, including a Date, a Time, a designated Field, a Price, a Format, and an Intensity Level. These Events primarily consist of Football games.
• Services: The Services provided by the app encompass a wide range of features, functionalities, and content, including but not limited to Managing events (creation and deletion), Exploring available events, Joining events, Dropping participation from events, and Managing Challenge Requests.
• Challenge: A Challenge feature allows a Team Manager user to initiate a request for their Team to join an event as a guest team. The request is then subject to approval or declination by the Host, who is the user organizing the event.
• Host: The term "Host" refers to the User who takes on the role of organizing an event on the app.
• Guest: In the context of the app, a "Guest" refers to a User who participates in an event organized by the Host.
• Field: A Field represents a football playing area, defined by a Name, Address, City, and Postal Code, within the app's event descriptions.

User Obligations

As users of our app, you bear the responsibility to uphold specific obligations to ensure the smooth operation and security of the platform. These obligations include providing accurate and truthful information during registration, maintaining the confidentiality of login credentials, and complying with all rules and guidelines prescribed by the app. Any misuse, unauthorized access, or violation of these obligations may result in account termination or legal action.

Intellectual Property

The app is protected by intellectual property rights, which include trademarks, logos, and other proprietary information. Users are strictly prohibited from using or distributing any of the app's intellectual property without obtaining explicit permission.

Liability and Disclaimers

The app explicitly disclaims any responsibility for losses, damages, or injuries that may occur during games or interactions facilitated by the platform. It is essential to acknowledge that the app does not guarantee the accuracy of all information provided, including game availability. Users should be aware of any limitations of liability outlined in the terms and conditions.

Termination

The app reserves the right to suspend or terminate user accounts under certain circumstances. These circumstances may include, but are not limited to, violation of the app's terms and conditions, inappropriate behavior that is not aligned with the goals and values of the community, or any other misuse of the app's features and functionalities. Users also have the right to terminate their accounts at any time if they wish to do so. Ensuring a respectful and appropriate environment for all users is of utmost importance, and any actions that disrupt or harm the community may result in account termination. By using the app, users agree to adhere to the terms and conditions and respect the guidelines set forth for a positive and well-organized experience within the app's community.

Amendments

The app reserves the right to update or modify its Terms and Conditions at any time, in order to reflect changes in its services, features, or applicable legal requirements. Users will be informed in a clear and appropriate manner if any substantial changes are made that could affect their rights or obligations. For minor or purely editorial adjustments, no individual notification will be sent, but the updated version will always be available in the app. A "Last Updated" date will be displayed at the top of the Terms and Conditions. By continuing to use the app after the publication of updates, users acknowledge and accept the revised terms.

Cancellation Policy

To ensure a smooth and enjoyable experience for all users, we kindly request that users refrain from actions such as cancellations or dropping out from events, as these can significantly disrupt event organization. Instead, we encourage users to promptly update their attendance status to keep everyone informed.

Payment & Refund Policy

All payments for participation in events are processed through the app in accordance with the methods available in the "Wallet" section. The total amount due for participation includes both the event participation fee and applicable service fees. Service fees cover operational costs and platform improvements and are non-refundable.

Refund Eligibility

• More than 48 hours before the event: 100% refund of the participation fee.
• Between 48 hours and 24 hours before the event: 50% refund of the participation fee.
• Less than 24 hours before the event: No refund.

Refunds are processed to the original payment method or credited to the user’s Wallet, depending on the available options.

Rewards & Incentives

The app may offer a reward system, referred to as "Omby Gems," to incentivize user engagement. Organizers may earn Omby Gems when players join events they host. Omby Gems can be redeemed as a form of payment, in whole or in part, for event participation, subject to the rules and conditions set out in the app’s Rewards Policy. The number of gems earned, redemption rates, and any restrictions are subject to change at the app’s discretion. Omby Gems hold no cash value and cannot be exchanged for currency outside the app.
